Ending a relationship when you're living together

Your options 

This advice doesn't apply if you're married or in a civil partnership - see Deciding whether to end a marriage or civil partnership.

If you're living with your partner and your relationship ends, you don't have to take any legal action to separate. You can simply stop living together and say you're no longer in a relationship. You do need to tell some people and organisations. 

However, there may be issues about children, housing, property and money to sort out. This can be done either by informal agreement or by making a written separation agreement - see heading Separating with a separation agreement.

If you can't agree about children, money or housing, you might need to go to court to settle it. You should consult a family law solicitor. Check our advice about using a solicitor. 

Who to tell when you separate

If you and your partner are separating, you may need to inform your:

  • landlord or housing office
  • housing benefit office
  • council tax office
  • mortgage lender
  • gas, electricity and telephone companies
  • benefits office
  • tax office, particularly if you're getting tax credits
  • current school and future school if you have children and they are moving
  • bank or any other financial institution if you have a joint account. It may be advisable for you to freeze the account to prevent your partner withdrawing some or all of the money
  • hire purchase or credit companies
  • insurance companies, particularly if you have joint policies
  • the post office, if you want mail redirected
  • doctor, dentist and child health clinic.

Separating with a separation agreement

A separation agreement is a written agreement between a couple who have decided to stop living together. It sets out how you wish to sort out issues about money, property and arrangements for the children.     If you are not the natural parent but are living with them and have adopted the children as a single person with the natural parent’s consent, you will share parental responsibilities and rights with the natural parent.

    Decisions the court can make about children

    If you can't agree about what should happen to the children the court can make decisions about:

    • who the child should live with - called a residence order
    • who the child should have contact with - called a contact order, including what sort of contact it should be and whether it should be supervised
    • whether the father should have parental responsibilities and rights.

    A court will only make decisions about children if it's in the best interests of the child to do so.

    You may find it helpful to use a mediation service or collaborative practice to help you reach an agreement without having to go to court.

    Financial arrangements at the end of a relationship

If you want to ask the court to make such an order you have to do so within one year of the date you stopped living together. The court can also make a number of orders about property you have shared.     If you don't have children, you may be able to claim a financial interest in your home if you can show you contributed financially by, for example, paying for improvements or towards mortgage repayments. If you have a financial interest in your home you might be able to make a claim to recover money paid towards the home. You'll need to get legal advice about this. Yet, a simple way to keep heartbreak and ill health at bay would be to spot the symptoms and sidestep these on time.     Given that money conflicts are often cited as a prime reason for divorce, it would appear elementary to identify and resolve these while dating. Yet, money is often the last thing on a cavorting couple’s mind while seeking compatibility. Even as the datingduo seeks similarities in personalities and habits, they refuse to look for common financialground. “To sustain a relationship, it is important for a couple to be on the same page when it comes to financial values,” says Mrin Agarwal, Founder & Director, Finsafe. These would include the same outlook on saving, spending, investing risks, loans, and approach to goals, among other things.

    It can be argued that since the root of most financial conflicts lies in the person’s psyche, a personality match can take care of money fracas. However, most complex and insidious traits that tend to remain hidden in daily interactions, emerge with ease in financial dealings. So it is easier to identify these if you are on the lookout for financial red flags. For instance, trying to dictate financial behaviour to a partner or looking down upon his or her spending choices is a clear indicator of deep-seated complexes or psychological issues. It is best to separate from such a partner while dating instead of wracking your head over the issue after marriage.

    Besides, these red flags will serve as a beacon for a mind muddled by sentiment. Love may be a haze that heightens your senses, but it can also cloud your reasoning. “When you are in love or in the early stage of dating, you tend to believe and justify everything about your partner,” says Agarwal. This story, then, is meant to serve as a red alert for the hormonally hampered couples so that they can find financial focus.

    We list for you some of the common and not-so-obvious financial red flags—actions, habits and behaviour patterns—that can hint at bigger problems you may or may not be able to rectify in the future. These dating alerts are intended to help you put a finger to the problem and take remedial measures to secure your finances and relationship. We also tell you whether a behaviour or money situation warrants a break-up or not. So even as you enjoy your love-fuelled outings, keep an eye open for these red flags.

    1. Refuses to split money on outings
    If, even after the first four or five dates, your partner shows little inclination to share the expenses, take it as a sign of things to come. Either (s)he is not serious about the relationship or expects to be financially supported by you for the rest of his or her life. “When we started going out last year and the bill was presented to Yash each time, I used to get irritated,” says Snehal Ravasia, the year-old investment banker, who started dating in August last year and is set to marry him this month. They either split the bill or alternated between paying these.

    Unwillingness to split money not only reflects scant respect for the partner’s commitment and money, but could also point at a person who is not earning too well or saving enough. He could even be a freeloader who is not fully invested in the relationship. If this continues for long, it’s a good idea to move on.

    2. Lies about money
    Lying is a form of financial infidelity that can destroy a relationship. If your date has lied to you about sundry things, this behaviour can stretch to finances as well. It can range from small lies like hiding cash to bigger ones like concealing debt, lying about salary, and secret purchases or accounts. It can have serious consequences like upsetting the budget, or failure to meet goals like retirement. Lying typically springs from guilt or is an act of rebellion against the other partner’s controlling behaviour, or simple fear about the partner’s reaction to an impulsive act.

    Can you live with financial deception in your partner? “You can tolerate differences in financial values only up to a point. There are some traits you are born with, while other issues are too deep-seated to be rectified by talking and discussing,” says Agarwal. So be realistic about salvaging the situation, talk to the partner more often and don’t try to force your way in the relationship. If you see an improvement and can ignore minor lies about spending, continue. If not, move on.

    3. Refuses to talk about finances
    A big red flag to keep your eyes peeled for is a partner’s refusal to discuss finances even after you have been going around for a few years and are serious about taking your relationship to the next level. “Reluctance to talk about money in the initial stages of dating is natural; in fact, it would be awkward if someone displayed too keen an interest in your finances right at the beginning,” says Taresh Bhatia, Certified Financial Planner.

    However, displaying an unwillingness, irritability or anger while talking about money even after a few years of dating is a definite warning sign. “Typically after marriage, most men are hesitant to share information about finances, be it income, expenditure or investments,” says Agarwal.

    Refusal to discuss could spring from a desire to retain financial control in partnership, or due to embarrassment about failed investments, or the sheer inability to manage money and admitting it to the partner. If a man earns less than a woman, the reluctance to talk could be from a feeling of insecurity or an act of rebellion. It would, however, be foolish if you detect this behaviour early on and do not take definitive action.

    If the refusal is due to controlling behaviour, it’s best to split because the nature is unlikely to change and could be damaging for your mental and financial health. If you have tried talking several times without any progress, try counselling. If that doesn’t work or the partner refuses to go for it, it is best to snap the bond and move on.

    4. Has no assets despite years of work
    If your partner has been working for years and has no asset, physical or financial, see it as a red flag. “If a young, single earner is not investing at least 50% of his salary, has not formulated goals and is not saving for them, it should serve as a warning,” says Bhatia. It shows financial irresponsibility and lack of planning, and could lead to poor money management or inability to meet financial goals after marriage.

    While it’s unfair to expect someone at the start of his career to buy a house or a car, (s)he should have financial assets, such as mutual fund investments or fixed deposits. These hint at foresight and willingness to plan for goals. “We are paying for our wedding from our savings,” says Yash Sotta, 35, a marketing manager in Mumbai. He also has his own car and camera equipment. Even depreciating assets like a bike or laptop bought with one’s money should be seen as a positive sign of earning capacity and financial independence.

    5. Borrows frequently from you or parents
    Do you dislike month-ends because your partner invariably seeks a handout to help sail through the month? If (s)he frequently runs out of money and looks for financial help or bridge loans from you or his own parents, it’s best to be cautious. While a rare financial crisis is understandable, it is not acceptable to live beyond one’s means and spend more than you earn, on a regular basis. Such chaotic money management and lack of budgeting will not allow you to save and eventually derail your financial goals.

    “I have a much lower income compared to my boyfriend’s, and I often go overboard with my shopping. So I feel the need to borrow from him and my parents every month, but I never do it,” says Aanchal Dahiya, a year-old Delhiite, who is learning to save, thanks to the gentle prodding from her partner.

    6. Can't retain a job for long
    Kolkata-based Sharad Kumar is into his seventh job in five years and, at `25, a month, it’s not the most high-paid of salaries as well. “I have expertise in a niche field that has very few takers at present,” explains the year-old. Little wonder then that his fiancee’s parents had an issue about him marrying their daughter. It is indeed a matter of concern if your partner is unable to hold on to a job for long.

    It could indicate not only a lack of professionalism or expertise in the chosen field, but also an inability to cohabit or get along with co-workers. This is unlikely to bode well for a long-term relationship, besides the fact that a stunted career growth may not result in financial stability after marriage. This could spark fights and force you to split. It’s better to take a call on this issue before marriage and part ways if there is unlikely to be an improvement in the partner’s career prospects.

    7. Expensive gifts, flashy lifestyle
    “We have never given each other gifts that are not needed or are unlikely to be used,” says the Mumbai-based businessperson Khyati Vasa, Her boyfriend of eight years, Viraj Shah, is in complete agreement.

    “If your partner is giving expensive gifts and taking you to fancy places even though he doesn’t have a high income, you should question it,” says Bhatia. It could point at a spendthrift nature which may be difficult to change. You may think he will tone down after marriage, but it will not happen, adds Bhatia.

    You should also pay attention to his lifestyle, the kind of clothes and accessories he wears or the vehicle he drives, as these may hint at an extravagant lifestyle that is not commensurate with his salary. Listen carefully to how he talks about money as well. “If he is only talking about how he wants to spend, not about how he wants to save or invest, be wary,” says Bhatia.

    8. Is always late for payments
    Not paying your credit card bills on time and in full, being late for utility payments or missing insurance premiums or loan EMIs are all indicative of a lazy, procrastinating or a disorganised person. These traits could prove to be the nemesis for a partner who wants to lead a stable, organised financial life and reach one’s goals without hiccups.

    It may seem like a frustrating habit to get used to in a partner, but can be remedied. “I have automated all my bill payments, except for the credit card, which I pay in full and on time,” says Sotta. So, while you need to be cautious about such a partner, it should not be a cause for splitting.

    9. Dictates financial behaviour
    One of the worst personality traits that should put you on an instant alert is manipulative behaviour in a partner. Does your date dictate how you should save or spend, what you should buy or wear, where you should invest? If you try to contradict him or have your own way with money, does he react violently, sulking for days?

    If your answer to any of these questions is a ‘yes’, it is an unambiguous cue for you to get out of the relationship at the earliest. “If you allow your date to plan your finances even before marriage, you will have no freedom, financial or otherwise, afterwards,” says Agarwal.

    “Mohsin is never rude or forces me to cut on my spending, but explains very gently why I need to curb it,” says Dahiya of her boyfriend. It’s the reason she has decided to start saving and be more careful about how she spends.

    Follows investing tips blindly
    You can’t expect to know all about your partner’s investing habits right after you start dating. However, if you see him take advice on markets or other investment avenues from all and sundry, and follow it blindly, sit back and think.

    If a person does not have the expertise to invest and follows market tips or tax advise from unprofessional sources, it is a surefire way of losing money. While it is not a big enough reason to dump your date, you should sit together to have a talk on how approaching a financial adviser may be a better option. If he agrees, you are good to go.

    It’s all about money and no results

    The apps prices have significantly went up for the premium services than what they used to be and a bit more ridiculously priced from other apps. Like now you can’t see who’s swiped on you unless you have the gold service when it used to be on the plus service which plus practically serves no purpose and even now with having the gold service even though I can see who swipes on me it’s as if I don’t get any swipes because the app keeps promoting for you to buy boosts and I used the one free boost and got tons of swipes! But now not using boost and not wanting to pay for boost I get like 10 swipes a day and I’ve only had gold membership for a week now and I do swipe on other people as well and can see who is still in the que for who I have swiped on and it seems as though tinder isn’t showing me in their swipe stacks because I would of guessed those people to of swiped yes or no on me by now. The experience on here in general has been worst than it has in the past. As far as dating apps go Tinder has significantly went down and I would say try else where unless you want to spend a lot of money for no results and am already regretting my decision and it has been a huge waste of money. In the past it wasn’t that big of a deal because it was decently priced but now it costs a lot more for it to actually be considered a huge waste. After my subscription ends I’m for sure never downloading this app again.

    Oh boy

    Just recently got out of a relationship and decided to dive back into the dating app world, and all I have to say is wow. Tinder has really slipped. What used to be a brilliantly simple and effective dating app has turned into a frustrating, convoluted, pay-walled mess. For Tinder to be even remotely useful, you have to pay for it. And once you do, you’re allowed features that are literally free on other apps. Wanna see who likes you? You’re going to have to pay more a month than you do on a Netflix subscription for that. Btw, Hinge does that for free. Wanna leave a comment on someone’s picture? Surely you can do that with the Gold membership, right? Nope. Gotta shell out even more money for ~platinum~. Guess who also does it for free? You got it. Hinge (and I think OKC too). And even after emptying your wallet on one of their higher subscription tiers, you still only get one boost a week, and you’re still hounded with pop ups every 10 minutes to try out their creepiest feature - the super like. All of this on top of the inherent dating app negatives (ghosting, catfishing, creeps, excessive filters, etc) and you’re in for a miserable ride. Save yourself the stress and money and try literally any app other than Tinder. Or just go to a bar. You’ll spend about the same amount of money but at the very least you’ll get a good buzz.

    Ending a relationship when you're living together

    Your options 

    This advice doesn't apply if you're married or in a civil partnership - see Deciding whether to end a marriage or civil partnership.

    If you're living with your partner and your relationship ends, you don't have to take any legal action to separate. You can simply stop living together and say you're no longer in a relationship. You do need to tell some people and organisations. 

    However, there may be issues about children, housing, property and money to sort out. This can be done either by informal agreement or by making a written separation agreement - see heading Separating with a separation agreement.

    If you can't agree about children, money or housing, you might need to go to court to settle it. You should consult a family law solicitor. Check our advice about using a solicitor. 

    Who to tell when you separate

    If you and your partner are separating, you may need to inform your:

    • landlord or housing office
    • housing benefit office
    • council tax office
    • mortgage lender
    • gas, electricity and telephone companies
    • benefits office
    • tax office, particularly if you're getting tax credits
    • current school and future school if you have children and they are moving
    • bank or any other financial institution if you have a joint account. It may be advisable for you to freeze the account to prevent your partner withdrawing some or all of the money
    • hire purchase or credit companies
    • insurance companies, particularly if you have joint policies
    • the post office, if you want mail redirected
    • doctor, dentist and child health clinic.

    Separating with a separation agreement

    A separation agreement is a written agreement between a couple who have decided to stop living together. It sets out how you wish to sort out issues about money, property and arrangements for the children. Examples of things you might want to include in an agreement are:

    • not to harass, annoy or disturb your former partner
    • to provide financial support (maintenance) for any children of the relationship. Any agreement not to apply to a court or to the Child Maintenance Service in the future does not count legally
    • who the children should live and have contact with.

    The advantage of a written agreement is that it's easier to make sure that you both understand what has been agreed. It also means that either of you can go to court to change the agreement at a future date. It's advisable to consult a solicitor when drawing up a separation agreement, but you should work out in advance the general areas you want to cover. This will reduce the legal costs. You may be able to get help with legal costs.

    The Scottish Government's 'Your Parenting Plan' is a guide to making practical arrangements for your children if you live apart.

    Arrangements for children 

    If you don't have parental responsibilities and rights under the law you have no automatic right to have a say in the children's future, or see them. If your ex-partner doesn't want you to be involved with the children you'll have to apply to court for an order for parental responsibilities and rights. 

    When you are the biological parents of the children and are not married to each other only the mother has full parental responsibilities and rights unless:

    • you jointly registered the birth of the child on or after 4 May  
    • you made and registered a Parental Responsibilities and Parental Rights agreement. The agreement does not take effect until registration
    • a court has made an order giving parental responsibilities and rights to the father.

    If you are the father but have no parental responsibilities and rights you still have to support the children financially, see heading Child Maintenance Service.

    If you're in a same sex relationship and one of you is the natural parent, only that partner has automatic parental responsibilities and rights unless:

    • the other partner adopted the child
    • a court has made an order giving parental responsibilities and rights to the other partner, or
    • the child was conceived by donor insemination or fertility treatment on or after 6 April When a child has been conceived in this way the second partner has a number of options about how to be the second legal parent. You can find more information on the Human Fertilisation and Embryology Authority website. 

    If you are not the natural parent but are living with them and have adopted the children as a single person with the natural parent’s consent, you will share parental responsibilities and rights with the natural parent.

    Decisions the court can make about children

    If you can't agree about what should happen to the children the court can make decisions about:

    • who the child should live with - called a residence order
    • who the child should have contact with - called a contact order, including what sort of contact it should be and whether it should be supervised
    • whether the father should have parental responsibilities and rights.

    A court will only make decisions about children if it's in the best interests of the child to do so.

    You may find it helpful to use a mediation service or collaborative practice to help you reach an agreement without having to go to court.

    Financial arrangements at the end of a relationship

    At the end of a relationship, both parents are responsible for supporting their children financially regardless of where the children will live. The responsibility can last until a child is 25 if they are in training or studying full-time. The responsibility can also extend to children accepted into the family. You may find it helpful to get more details about this from a Citizens Advice Bureau. The father is equally responsible even if he stops living with the mother and even if he is not named on the child's birth certificate but only if he is the natural father. It doesn't matter whether he has got parental responsibilities and rights or not. He can be contacted by the Child Maintenance Service for financial support. For more information about parental responsibility, see heading Arrangements for children.

    Neither you or your partner has a duty to maintain the other at the end of a relationship if you were not married or in a civil partnership. Financial arrangements can be arranged:

    Agreeing on financial support

    If you both agree to financial support, this is called a voluntary agreement or family-based agreement. It can be written down or it could be a verbal agreement.

    You can agree, for example, that one of you will make weekly payments to the other for the support of children, or will meet rent or mortgage payments, household bills, or pay for the children's clothing and holidays.

    If you need advice on the options available for arranging child maintenance and for advice on how to set up a family-based child maintenance agreement, you can contact the Child Maintenance Service. 

    Before you agree on a package of financial support, it may be useful to get legal advice about whether it is an appropriate arrangement. It may also be useful to have an agreement drawn up by a solicitor in case of future dispute. You might get help with the legal costs of making a voluntary or family-based agreement.

    The Child Maintenance Service (CMS)

    If your relationship has ended and the children are living with you, you can use the Child Maintenance Service (CMS) to get financial support for your children. However, you don't have to use the CMS if you don't want to.

    The CMS is the government child maintenance service that arranges maintenance for children under the Scheme.

    Court orders

    In some circumstances, the court can make an order for financial support for the children. It can make an order for financial provision for you or your partner.

    A court can make an order for regular payments for specific circumstances, for example, expenses to help with a child's disability. It can also make an order for one partner with parental responsibilities to give money to the person caring for the children. If you want to ask the court to make such an order you have to do so within one year of the date you stopped living together. The court can also make a number of orders about property you have shared. As this can be complicated you should get more details from a Citizens Advice Bureau. Find out more about the advice options we offer. 

    If you apply to court for financial support for the children, you might be able to get help with legal costs. However you may have to pay towards these costs from money or property you get as a result of the court action. Make sure your solicitor explains the charges properly to you before you start court action.

    Housing rights at the end of a relationship

    At the end of your relationship, a court can give you or your partner rights to the home, for example:

    • the right to stay in your home
    • the right to come back home to get your things
    • the right to stop your partner from coming into the home.

    If your partner has been violent to you, the housing rights of the violent person may be temporarily set aside. For example, they may be excluded from entering the home.

    Rights to the home for owner-occupiers

    If you and your partner live in owner occupied property and only one of you is the owner of the property only the owner has the right to stay in your home.

    If the owner wants you to leave, you have to go unless a court has given you rights to stay. If you have children a court might give you rights for 6 months to stay in the home even when you don't own it. You will need more advice about this.

    If you don't have children, you may be able to claim a financial interest in your home if you can show you contributed financially by, for example, paying for improvements or towards mortgage repayments. If you have a financial interest in your home you might be able to make a claim to recover money paid towards the home. You'll need to get legal advice about this. You could get help with legal costs.

    If you do own your home jointly with your partner and you decide to leave, you should take steps to protect your right to go back there if you want to. You should try and agree about whether the home should be sold. One joint owner can go to court to try and force the sale of the property. You will need to get legal advice about this. You could get help with legal costs.

    Rights to the home in rented property

    What rights you have to stay in the home will depend on whether only one of you is the tenant or you share the tenancy. As a sole tenant you can ask the other partner to leave unless a court grants rights for your partner to stay.

    If you have children a court can grant rights for a parent who is not the tenant to stay, initially for 6 months.

    When you share the tenancy, you have equal rights to stay in the home. If one partner has been violent a court can exclude the violent partner even if they are the sole tenant.

    Paying the mortgage when a relationship breaks down

    If a mortgage is in joint names, both people are jointly and solely liable for the mortgage payments. This is known as joint and several liability.

    This means that if one of you leaves and stops contributing to the mortgage payments, the lender can ask the other person to pay the full amount.

    If a mortgage is in one person's name, only that person is liable for the mortgage payments.

    If you're not married or in a civil partnership and your name isn't on the mortgage, the lender may try and repossess the property. You could offer to make the mortgage payments when your partner leaves and the lender may agree to accept them. However, it doesn't have to accept.     Paying the rent when a relationship breaks down

    Joint tenancy

    A joint tenancy means that all of the tenants named on the tenancy agreement are jointly and solely liable for the rent. This is known as joint and several liability.

    If the other joint tenant leaves and stops making payments towards the rent, the landlord can ask the other person to pay the full amount. It's important to keep paying the full amount, otherwise you may get evicted.

    In some cases, a joint tenant may end the joint tenancy by giving notice to the landlord. If you want to stay in the property you'll need to make sure this doesn't happen or if it has happened, you can negotiate with the landlord. Your landlord may be able to give you a new tenancy in your name only.     Sole tenancy which is not in your name

    If a tenancy is in the name of your partner, they will be liable to pay the rent for as long as the tenancy continues. If the rent isn't paid and arrears build up, the landlord may take action to evict you.

    Benefits and housing costs

    If you stay in your home after your partner has left, depending on your income, you may be able to get Universal Credit to help pay the rent. If there is a mortgage, you may be able to get help with the mortgage interest.

    Family mediation and other help

    Family mediation is a way of helping you and your partner sort out disagreements when your relationship breaks down. Mediators are people who are trained to listen to both sides, and to help you and your partner agree on what will be best for yourselves and the children. To use this service, you both have to be willing to go along voluntarily. 

    You might have to pay for mediation, depending on the provider.

    If you can't afford it, you might be able to get legal aid to help with some of the costs. You should look for a mediator who does legal aid work.

    You can find trained mediators through Relationships Scotland or CALM Scotland.

    The Spark

    The Spark provides relationship counselling services for families, couples, individuals and young people and has regional centres across Scotland where clients can access face to face counselling. Telephone and online counselling is also available. There is a charge for counselling but what you have to pay can be negotiated. The Spark has a relationship helpline offering immediate relationship support. Calls are free from landlines and mobile networks.     Collaborative practice

    Collaborative practice is another way of sorting out disagreements and reaching solutions when your relationship breaks down, without having to go to court. The process involves you and your partner meeting with your solicitors to look at the issues that need to be resolved and trying to reach agreement.
